States Have Made Significant Legislative Changes
Many states have recently enacted important legislation affecting employers. For example, Delaware, Illinois, Missouri, New York and North Carolina have all adopted changes that impact employer-sponsored employee benefit plans; Illinois, Iowa and New York have expanded their fair employment practices laws; and Illinois and Washington have made changes to their family, medical and parental leave laws.

Work Week Can Finally Be Shortened for Exempt Employees
California has recently softened the rule that, if an exempt employee works any part of a work week, then she is entitled to the entire week's pay, and now permits employers to staff exempt employees according to the needs of their business and pay them accordingly.

NY- New York Workplace Law News
Health Department Suspends Mandatory Flu Vaccine Requirement
The New York Health Department has suspended its requirement that health care workers receive vaccinations for the H1N1 virus and the seasonal flu, Gov. David A. Paterson announced, saying that because of the vaccine’s scarcity, the limited amounts currently available should be reserved for “those who are at the highest risk for complications from the H1N1 flu”— pregnant women and children and young adults.

Maine to Hold Hearings on Employee Misclassification
The Governor’s Task Force on Employee Misclassification will be holding public hearings in November 2009, to examine the problem of misclassifying workers as independent contractors instead of employees.

NV - Nevada Workplace Law News
Nevada Rejects Wrongful Discharge Action by Employee Seeking to Unionize Workers
The Nevada Supreme Court has declined to recognize a cause of action for wrongful discharge asserted by an employee seeking to organize his fellow workers. Because the employee had an alternate remedy under the federal Railway Labor Act, the court declined to recognize a new exception to Nevada’s at-will employment rule.
